Terms and conditions governing use of Desert Maritime.

Effective Date: November 17, 2025

Welcome to Desert Maritime (“Company,” “we,” “us,” or “our”).
These Terms of Use (“Terms”) govern your access to and use of https://desertmaritime.com (the “Site”).

By accessing or using the Site, you agree to be legally bound by these Terms.
If you do not agree, you must discontinue use immediately.

1. Eligibility

4. Assumption of Risk

Outdoor recreation involves inherent risks including serious injury or death.

  • Wildlife encounters

Conditions change rapidly in desert and river environments.

By using this Site, you voluntarily assume all risks associated with acting on information provided herein.

5. Utah Recreational Use Statute Notice

To the fullest extent permitted by law, Desert Maritime invokes the protections of the Utah Limitation of Landowner Liability Act (Utah Code § 57-14-1 et seq.), commonly referred to as the Utah Recreational Use Statute.

Under Utah law:

  • Landowners and those facilitating recreational use of land owe no duty of care to keep premises safe for entry or use for recreational purposes.
  • Permission to use land for recreational purposes does not create a duty of care.
  • No assurance is given that premises are safe for any purpose.

To the extent Desert Maritime publishes information about public or private lands, routes, waterways, campsites, trailheads, or other outdoor environments, such publication does not:

  • Create any duty of care
  • Constitute a representation of safety
  • Create liability for conditions on land not owned or controlled by Desert Maritime

Nothing on this Site should be interpreted as a guarantee of safety for any land, route, or recreational activity.

6. No Guide-Client Relationship

Use of this Site does not create:

  • A professional guide-client relationship
  • A fiduciary duty
  • A safety guarantee
  • An endorsement of expedition plans

Desert Maritime is a content publisher, not your expedition leader.

7. Affiliate Disclosure

The Site participates in affiliate marketing programs.

This means:

  • There is no additional cost to you.

We do not:

  • Control third-party retailers

10. Media Release & User Photo Consent

If you:

  • Submit photographs, videos, or media to Desert Maritime
  • Tag Desert Maritime on social media
  • Participate in Desert Maritime events, meetups, or expeditions
  • Appear in photographs or video captured by Desert Maritime

you grant Desert Maritime a perpetual, worldwide, royalty-free, transferable license to:

  • Use, reproduce, publish, display, distribute, and modify such media
  • Use your likeness, voice, image, and biographical information
  • Publish such materials in digital, print, social media, advertising, promotional, or commercial contexts

You waive any right to inspect or approve the finished product.

You release and discharge Desert Maritime from any claims arising from use of such media, including but not limited to:

  • Claims for compensation
  • Claims for defamation
  • Claims for invasion of privacy
  • Claims for right of publicity

If you do not wish to appear in media published by Desert Maritime, you must notify us in writing prior to the event or submission.

11. User Conduct

You agree not to:

  • Use the Site for unlawful purposes
  • Attempt unauthorized access
  • Interfere with Site functionality
  • Upload malicious code
  • Post defamatory or harmful content

We may suspend or terminate access at our discretion.

12. User-Generated Content

If you submit content:

  • You grant us a perpetual, worldwide, royalty-free license to use it.
  • You represent that you own or control the rights to it.
  • We may remove content at our discretion.

13. Third-Party Links

We:

18. Arbitration & Dispute Resolution

Any dispute arising out of or relating to these Terms or the Site shall be resolved by binding arbitration in the State of Utah.

You agree:

  • To waive the right to trial by jury
  • To waive participation in class actions
  • That arbitration shall be conducted individually

Each party shall bear its own costs unless otherwise determined by the arbitrator.

19. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict of law principles.

20. Modifications

We may update these Terms at any time.

Continued use of the Site constitutes acceptance of revised Terms.

21. Severability

If any provision is deemed unenforceable, the remaining provisions remain in full force and effect.
